OBJECTIVE

 

WeVysya is committed to the highest levels of ethics and integrity in all aspects! WeVysya believes that when there is a moral conflict in the organisation; it must be addressed instantaneously as it is crucial and it affects the reputation and success of the organisation. We appreciate the professional responsibility that there is in each one of you and therefore this WHISTLE BLOWER POLICY has been implemented. WeVysya strongly encourages you to speak up if you suspect or witness any matters of concern (i.e. corrupt, illegal or other undesirable conduct). WeVysya will take all reports made under this Policy seriously. We would like to inform all the WeVysya Members how WeVysya will support you so that you can safely express your concerns openly.

 

SCOPE

 

This policy is applicable to all WeVysya affiliates, Leaders, Members, and Staff.


 

POLICY GUIDELINES/PROCESS

 

WHISTLE BLOWER DEFINITION

 

A Whistle blower is someone who discloses Reportable Conduct under this Policy. He can be WeVysya Global Team, Staff, Members, Contractors, Suppliers and Volunteers.

 

REPORTABLE CONDUCT

 

·       Criminal activities;

·       Fraud, forgery or defalcation;

·       Bribery or corruption;

·       Provision of misleading information or the falsification of financial or other records;

·       Breaches of copyright, patents and licences;

·       Violation of environmental legislation;

·       Violation of restraint of trade legislation;

·       Failure to comply with other legal obligations;

·       Violation of the Code of Conduct;

·       Violations of human rights, of child rights, use of child labour, workplace harassment, unfair treatment of WeVysya affiliates;

·       Insider trading in the company's shares;

·       Falsification of statutory reports and records, including the company's financial statements and accounting records;

·       Zero tolerance towards the following actions:

  • Incorrect gossiping, unkind remarks, unnecessary criticism, use of foul language towards WeVysya and its affiliates which includes Seniors Members, Peer Members, Contractors, Suppliers and Volunteers
  • Fighting, threatening, use of violence, misbehaving or mishandling WeVysya affiliates which includes Seniors Members, Peer Members, Contractors, Suppliers and Volunteers
  • Working under influence of alcohol or illegal drugs  during WeVysya meetings or while representing WeVysya in any external events

·       Breaches of other policies including code of conduct and concealing or overlooking any of the above.

 

Note:

 

1.     This is an illustrative list but is not limited to the same. Therefore Whistle Blower can report any other concerns also.

2.     Reportable Conduct excludes personal grievances and interpersonal conflicts between each other’s. It is not applicable for grievance related to Promotions and Recognitions.

3.     Zero tolerance violence’s will be subject immediate termination of membership or position at WeVysya.

4.     A personal grievance or inter personal conflict is not a reportable offence under this policy and doesn’t qualify for protection under the Whistle-Blowers Laws or this Policy. It is very clear that Whistle Blower must raise concerns that have significant implications on WeVysya.

 

WHISTLE BLOWER’S PROTECTION:

 

A Whistle Blower does not need to prove his/her allegations as reports made in good faith must be based on a reasonable belief that a wrongdoing has occurred or is likely to occur. If a subsequent investigation reveals that there was no Wrongdoing the Whistle Blower (i.e. Person) making the report would not be subjected to any victimization or disciplinary action if he/she has acted in good faith.

 

COMPLAINT MECHANISM:

 

Whistle Blower may disclose any Reportable Conduct to the Whistle Blower Report Officer (WRO) in writing and Whistle Blower can choose to remain anonymous. It may be difficult to conduct the right/correct investigation when the complaint is raised anonymously and therefore WeVysya encourages you to share your identity when making a disclosure, however you are not required to do so if you are not comfortable. RESOLUTION TEAM (RESPONSIBILITY MATRIX):

 

·      Whistle Blower Report Officer (WRO): WeVysya Founder

 

Role:

1.     All information received from you will be treated confidentially and sensitively.

2.     To receive complaints and forward the same to the Whistle Blower Investigation Team

3.     To protect the Whistle Blower from any victimization/harassment

4.     Take necessary disciplinary steps after receiving the investigation report

 

·      Whistle Blower Investigation Officers (WIO):

o   Internal Committee: WeVysya Global Board Members

o   External Committee: Will be appointed on need basis, via Board Resolution

 

Role:

1.     All information received from you will be treated confidentially and sensitively.

2.     Ensure unbiased and immediate thorough investigation takes place

3.     Whistle Blower’s identities must be protected and all concerns raised must be dealt with confidence

 

INTERNAL INVESTIGATION/ EXTERNAL INVESTIGATION:

 

All investigations will be conducted in a fair, independent and timely manner and all reasonable efforts will be made to preserve confidentiality during and after the investigation process.

Based on the severity of the complaint the Whistle Blower Report Officer (WRO) can conduct the investigation internally or externally.

 

RETENTION OF INVESTIGATION RECORDS:

 

Investigation records will be stored in WeVysya Office with utmost confidentiality for span of one year from the date of resolution.
